1. Introduction

1.1 Acceptance of Terms

By downloading, installing, or using the Dano Aesthetics mobile application (the “App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the App.

1.3 App Developer

The App is developed and published by Arvin Kit Gallego (Philippines) on behalf of Dano Aesthetics. The developer is responsible for technical aspects only. All services, appointments, and treatments are provided exclusively by Dano Aesthetics.

2. Description of Services

The App provides:

• Information about aesthetic and cosmetic treatments offered by Dano Aesthetics
• Appointment booking for consultations and treatments
• Appointment management (viewing, rescheduling, cancellation)
• Loyalty program tracking and membership benefits
• Communication with clinic staff
• Educational content about procedures

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years old to create an account and use the App independently. Users under 18 require parental or guardian consent and supervision.

3.2 Account Creation

You may create an account using:

• Email and password
• Google Sign‑In
• Apple Sign‑In (with “Hide My Email” option supported)

3.3 Your Responsibilities

• Provide accurate, current, and complete information
• Maintain the confidentiality of your login credentials
• Notify us immediately of unauthorized account access
• Maintain only one account per person
• Keep your email address current for communications

3.4 Account Verification

We may require email verification for:

• New account registration
• Email address changes
• Security‑sensitive actions

4. Booking Terms

4.1 Appointment Booking

• All bookings are subject to availability and confirmation
• Bookings are made for yourself only unless otherwise authorized
• Accurate medical and contact information must be provided
• We reserve the right to refuse service at our discretion

4.2 Booking Confirmation

Confirmed bookings will be sent to your registered email address. You will also see confirmed appointments in the App.

4.3 Cancellation Policy

User‑Initiated Cancellations:

We understand that plans change. You may cancel appointments through the App at any time before your scheduled appointment. We ask that you provide at least 24 hours notice when cancelling, as this allows other clients to book the time slot.

No‑Shows:

Repeated no‑shows (failing to attend scheduled appointments without cancellation) may result in restrictions on your account, including suspension of booking privileges.

Clinic‑Initiated Cancellations:

We may cancel or reschedule appointments due to:

• Emergency situations
• Staff availability
• Operational requirements

We will notify you via email and assist with rescheduling.

4.4 Rescheduling

You may reschedule appointments through the App subject to availability.

4.5 Payment Terms

• All payments for services are made at the clinic at the time of service
• No in‑app payments or subscriptions are processed through the App
• Prices for treatments are subject to change
• Consultation regarding pricing will be provided at the clinic

5. Loyalty Program

5.1 Program Overview

The Dano Aesthetics Loyalty Program rewards returning clients with membership tiers and benefits based on visit count:

• Visits are recorded by clinic staff after each completed appointment
• Only qualifying appointments count toward tier progression
• Visit history is maintained in your App profile

5.3 Program Terms

• Membership benefits are subject to change or discontinuation
• Rewards have no cash value and are non‑transferable
• Fraudulent activity will result in forfeiture of all rewards and possible account termination
• The program may be modified or terminated at our discretion with reasonable notice

6. Acceptable Use

6.1 You May:

• Book legitimate appointments for yourself
• View and manage your appointment history
• Update your account information
• Contact clinic staff through appropriate channels
• Access educational content about our services

6.2 You May Not:

• Create false or misleading accounts
• Book appointments you do not intend to keep
• Impersonate another person
• Use automated tools (bots, scrapers) to access the App
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal purpose
• Harass, abuse, or harm clinic staff or other users
• Upload malicious content or code

7. Account Suspension and Termination

7.1 Termination by You

You may delete your account at any time through the App or by contacting us. Upon deletion:

• Your active bookings may be cancelled
• Some data may be retained as required by law
• Loyalty program points will be forfeited

7.2 Termination by Us

We may suspend or permanently block your account if you:

• Violate these Terms
• Provide false information
• Engage in fraudulent or abusive behavior
• Repeatedly fail to honor bookings (no‑shows)
• Abuse clinic staff

7.3 Effect of Account Blocking

When your account is blocked:

• You will be automatically logged out immediately
• You will not be able to log back in
• Your appointment history will be retained for our records
• You must contact us directly to resolve the issue

7.4 Appeal

If you believe your account was blocked in error, contact admin@danoaesthetics.vip.

8. Intellectual Property

8.1 Our Content

All content in the App, including text, images, logos, graphics, and software, is owned by Dano Aesthetics or its licensors and protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the App for personal, non‑commercial purposes.

8.3 Restrictions

You may not:

• Copy, modify, or distribute App content
• Use our trademarks without permission
• Create derivative works
• Remove any copyright or proprietary notices

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.

10. Third‑Party Services

10.1 Authentication Services

The App uses:

• Google Sign‑In:Subject to Google's Terms of Service and Privacy Policy
• Apple Sign‑In:Subject to Apple's Terms and Conditions and Privacy Policy
• Firebase Authentication: Subject to Google Cloud Terms of Service

10.2 Infrastructure

The App is built on Google Firebase and Google Cloud Platform. Your use is subject to their service terms.

10.3 Disclaimer

We are not responsible for third‑party service availability or their terms and policies. Third‑party service outages may temporarily affect App functionality.

11. Disclaimers

11.1 Medical Disclaimer

The App provides information and booking services only. It does not provide medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical decisions.

11.2 Service Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

11.3 Availability

We do not guarantee uninterrupted or error‑free service. The App may be unavailable for maintenance or due to circumstances beyond our control.

11.4 Treatment Outcomes

Individual treatment results may vary. We do not guarantee specific outcomes from any treatment or procedure.

12. Limitation of Liability

To the maximum extent permitted by Israeli law:

• Our total liability for any claims arising from these Terms or the App shall not exceed the amount you paid to Dano Aesthetics for services in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• We are not liable for loss of data, business interruption, or lost profits.
• We are not liable for any actions or omissions of third‑party service providers.

This limitation does not apply to liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Dano Aesthetics, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third‑party rights
• Your provision of false information

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or the App shall be resolved exclusively in the competent courts of Israel, located in the Central District.

14.3 Informal Resolution

Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at admin@danoaesthetics.vip.

15. Changes to Terms

We may update these Terms at any time. Changes will be effective when posted in the App. We will notify you of material changes via:

• Email to your registered address
• Updated “Last Updated” date

Your continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the App.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dano Aesthetics regarding the App.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

16.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

16.4 Assignment

We may assign these Terms without notice. You may not assign your rights or obligations.

16.5 Language

These Terms are available in English and Hebrew. In case of conflict, the English version prevails.
